A Communications Offence has been alleged against a PC 21147 Begum of West Midlands police.
PC Begum used a police messaging systems to send repeated text messages to a victim of crime even after being asked to stop.
The victim contacted the police via email and reported the unwanted text messages, and asked for his mobile number to be removed from their system. What he expected was an email or letter addressing the complaint, but what he received was a further text messages.
The victim sent a further email (PSD were included in the same email) reporting them for abusing the system and not removing the mobile number after being asked. The victim received no response by email, but again received more unwanted text messages.
After making it absolutely clear that text messages were not wanted, PC Begum even asked the victim for an alternative mobile number… via text message.
The offence was ignored by PSD so reported via the IOPC.
The victim has reported it as a Communications Offence under s127 of the Communications Act 2003
s127 (2) Communication Act 2003;
(2) A person is guilty of an offence if, for the purpose of causing annoyance, inconvenience or needless anxiety to another, he—
(a) sends by means of a public electronic communications network, a message that he knows to be false,
(b) causes such a message to be sent; or
(c) persistently makes use of a public electronic communications network.
